Terms and Conditions

These Terms and Conditions govern your access to and use of the websites and online stores listed below, including purchases of digital books, audiobooks, printable PDF products, and time-limited access passes. Please read these Terms before using a Site or placing an order. By using a Site, creating an account, or completing a purchase, you agree to these Terms and our Privacy Policy.

The Sites are operated by Emery Road Writing Services, LLC. Emery Road Publications is a publishing brand operated by Emery Road Writing Services, LLC. In these Terms, “we,” “us,” and “our” refer to Emery Road Writing Services, LLC, and “you” refers to a visitor, customer, account holder, member, commenter, or reviewer.

Sites Covered by These Terms

These Terms apply to the following websites and to stores, account areas, membership areas, and services operated through them:

Additional terms displayed with a particular product or feature are incorporated into these Terms. If an additional term conflicts with these Terms, the more specific term controls for that product or feature.

Eligibility and General Use

You must be at least 18 years old, or use a Site with the involvement and permission of a parent or legal guardian who agrees to these Terms. The Sites are intended primarily for customers in the United States. You are responsible for using the Sites and products in compliance with laws that apply to you.

You may use the Sites only for lawful, personal purposes. You may not interfere with Site operation or security; attempt unauthorized access; introduce malicious code; scrape or harvest information through automated means without permission; impersonate another person; use false payment or account information; or use a Site to infringe the rights of another person.

Accounts and Account Security

Customer accounts may be available, and guest checkout may also be permitted. Certain restricted content, including the Emery Road Story Vault, may require an account. When creating an account, you agree to provide accurate information and keep it current. You are responsible for protecting your username and password and for activity conducted through your account.

Please notify us promptly at inquiries@emeryroad.com if you believe an account has been accessed without authorization. We may suspend, restrict, or terminate an account when reasonably necessary to protect the Sites, customers, our rights, or other users; investigate suspected fraud or misuse; enforce these Terms; or comply with law.

Products and Availability

The direct stores currently offer digital products and time-limited access passes. No physical item will be shipped for a product identified as an ebook, audiobook, digital download, printable PDF, or access pass. Physical books may be available from third-party retailers under their own terms.

We try to describe products accurately, but display colors, device presentation, narration availability, file compatibility, and other details may vary. We may correct errors, revise descriptions or prices, limit quantities, withdraw an offer, or cancel an order affected by a material pricing or listing error. If we cancel a paid order before providing the product, we will return the amount paid for that order.

Ordering and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, if any, are calculated at checkout. By submitting an order, you authorize our payment processor to charge the selected payment method for the displayed total. An order is accepted when payment is successfully processed and an order confirmation is issued, subject to fraud review and correction of material errors.

Discount codes and promotional offers may have separate eligibility requirements, expiration dates, product limitations, or usage limits. They have no cash value, may not be combined unless stated, and may be withdrawn where permitted by law. You agree not to initiate an improper chargeback for a purchase you authorized. This does not limit any rights you may have under applicable law or payment-network rules.

Digital Delivery

Digital products are generally delivered electronically through BookFunnel or another service identified at checkout or in the delivery email. Delivery may require you to follow a download link, access a browser-based reader or player, install a compatible reading or listening application, or provide limited device information to the delivery provider.

You are responsible for entering a valid email address, checking spam or promotions folders, maintaining a compatible device and internet connection, and downloading or accessing the product within any period stated in the delivery instructions. Delivery times may be affected by payment review, service interruptions, incorrect contact information, or circumstances outside our reasonable control.

Digital Product License

When you purchase a digital product, you receive a limited, nonexclusive, nontransferable, revocable license for your personal, noncommercial use. The purchase does not transfer copyright or ownership of the work or files.

Unless we expressly state otherwise in writing, you may not:

• Share, forward, upload, distribute, sell, sublicense, rent, or give the digital file or access link to another person
• Post the product or a substantial portion of it publicly or make it available through a file-sharing, membership, training, or artificial-intelligence system
• Remove copyright, trademark, attribution, watermark, access-control, or rights-management information
• Reproduce or adapt the product for commercial use, resale, or distribution
• Use the product in a manner that infringes copyright or other proprietary rights

You may make reasonable personal backup copies when the format and delivery service permit. Printable PDFs may be printed for the purchaser’s personal use only unless the product page expressly grants broader permission.

Final Sale and Technical Assistance

Because digital products are made available immediately after purchase, all sales of digital products and Vault Access Passes are final and nonrefundable, except where a refund is required by applicable law. Please review the product format, description, and device requirements before purchasing.

If you experience a technical problem, receive an incomplete or defective file, make a duplicate purchase, or do not receive delivery instructions, contact inquiries@emeryroad.com. We may ask for the order number and information reasonably needed to investigate. Depending on the issue, appropriate assistance may include resending delivery instructions, restoring access, replacing or correcting a file, referring the issue to BookFunnel, or addressing an accidental duplicate transaction. Providing technical assistance or replacement access does not create a general right to a refund.

Thirty Day Vault Access Pass

A 30-Day Vault Access Pass is a one-time purchase that provides access to designated Emery Road Story Vault content for 30 consecutive calendar days beginning when access is activated following successful payment. It is not a recurring subscription and does not automatically renew. No cancellation is required; access expires automatically at the end of the access period.

A new pass must be purchased to begin another access period. Unless required by law, unused time, failure to use the Vault, device incompatibility that was disclosed before purchase, or expiration of access does not entitle the purchaser to a refund, credit, extension, or prorated payment. We may reasonably modify the selection of titles or materials available in the Vault, but we will not intentionally shorten an active purchaser’s stated access period without providing an appropriate remedy.

Vault access is for the registered purchaser only. Login credentials, files, access links, and restricted content may not be shared. We may suspend access for suspected credential sharing, unauthorized distribution, fraud, security threats, or material violation of these Terms. If access was suspended in error, contact us so we can investigate.

Intellectual Property

The Sites and their contents, including books, stories, audiobooks, text, graphics, logos, cover art, downloads, page design, and other materials, are owned by or licensed to Emery Road Writing Services, LLC and are protected by copyright, trademark, and other laws. Author and imprint names may be used only to identify the applicable books or creators and may not be used in a way that suggests sponsorship, endorsement, or affiliation without permission.

Brief quotations and links may be used as allowed by law. No other right or license is granted except the limited digital-product license expressly stated in these Terms.

User Comments and Reviews

If a Site allows comments, product reviews, or other submissions, you retain any rights you hold in your original content. By submitting content, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content as reasonably necessary to operate, moderate, promote, and improve the Sites and products, subject to our Privacy Policy.

You agree not to submit content that is unlawful, threatening, abusive, defamatory, deceptive, infringing, invasive of privacy, obscene, malicious, promotional spam, or unrelated to the applicable post or product. Reviews should reflect genuine experience. We may moderate, refuse, or remove content, but we are not obligated to monitor every submission. Views expressed by users are their own.

Third Party Services and Links

The Sites rely on third-party services for payment processing, tax calculation, email automation, digital delivery, analytics, advertising, security, hosting, and other functions. The Sites may also link to retailers, social platforms, and other websites we do not control. Your use of a third-party service may be governed by that provider’s terms and privacy policy. We are not responsible for the independent content, availability, security, or practices of third-party sites or services, except to the extent responsibility cannot be excluded by law.

Service Availability and Changes

We may update, maintain, suspend, or discontinue a Site or feature. We do not promise uninterrupted or error-free operation. We will use reasonable efforts to address problems within our control and to avoid unnecessary interruption of paid, time-limited access. Events outside our reasonable control may affect availability, including internet or hosting failures, cyberattacks, payment or delivery-provider outages, natural disasters, governmental action, labor disruptions, or utility failures.

Disclaimer

The Sites and products are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not guarantee that a Site or product will meet every preference, operate with every device or third-party application, or remain available indefinitely.

Books and related content are provided for entertainment, literary, or general informational purposes. They are not professional medical, legal, financial, mental-health, or other individualized advice. Fictional characters, events, organizations, and settings may be invented or used fictitiously as stated in the applicable work.

Nothing in these Terms excludes an express product promise or a warranty, remedy, or consumer right that cannot lawfully be excluded or limited.

Limitation of Liability

To the fullest extent permitted by law, Emery Road Writing Services, LLC and its owners, personnel, authors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; or loss arising from unauthorized account access, third-party services, or inability to use a Site or product.

To the fullest extent permitted by law, our total liability arising from a particular paid product, access pass, or transaction will not exceed the amount you paid directly to us for that product, pass, or transaction. For claims unrelated to a paid transaction, our total liability will not exceed fifty U.S. dollars. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

Electronic Communications

By placing an order or creating an account, you agree to receive transactional communications needed to administer the purchase, delivery, account, security, or access pass. If you begin checkout and provide an email address, you may receive configured cart-reminder messages. Promotional newsletters require separate enrollment and may be unsubscribed from using the link in each message. Please see our Privacy Policy for more information.

Copyright Concerns

If you believe material on a Site infringes your copyright, email inquiries@emeryroad.com with identification of the copyrighted work, the material at issue and its location, your contact information, a statement of your good-faith belief that the use is not authorized, and a statement that the information you provide is accurate and that you are authorized to act for the rights holder. We may request additional information needed to evaluate the notice.

Governing Law and Disputes

These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law principles, except where another law must apply. Before filing a legal claim, you agree to contact inquiries@emeryroad.com and provide a reasonable opportunity to resolve the issue informally. This informal-resolution request does not prevent either party from seeking urgent relief or using a small-claims process where eligible, and it does not shorten any limitation period imposed by law.

Any court proceeding that is not brought in small claims court must be filed in a state or federal court with jurisdiction in Alaska, unless applicable consumer law gives you the right to file elsewhere. You and we retain the right to a court proceeding; these Terms do not require arbitration.

Changes to These Terms

We may revise these Terms when our products, services, providers, business practices, or legal obligations change. The revised Terms will be posted on the Sites with a new effective date. Changes apply prospectively unless law permits or requires otherwise. The Terms in effect when you place an order govern that transaction, except for later changes required by law or needed to protect security and prevent abuse.

Severability and No Waiver

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A delay or failure to enforce a provision is not a waiver of the right to enforce it later.

Entire Agreement

These Terms, the Privacy Policy, applicable product-page terms, and any other policies expressly incorporated at checkout form the agreement between you and us concerning the Sites and direct purchases. They do not alter separate terms between you and a third-party retailer or service provider.
